Privacy Policy

The WinExServices.biz (the “Site”) is operated by WinEx.  At WinEx, we respect your right to control your personal information.  Whether you are sending or receiving Shipments, we want to make sure that the personal information that you disclose to us remains secure.  That is why we have developed this Privacy Policy, which governs how we collect, use and disclose your personal information (the “Privacy Policy”).

This page contains the Privacy Policy for the Site, as well as any related subdomains, subsidiary sites, other websites or microsites operated by WinEx, and any tools, applications, forums, or social media pages (collectively, the “Sites”), and for courier services offered by WinEx (together with the Sites, the “Service”).

By using the Service, you consent to the collection, use and disclosure of your personal information by WinEx in accordance with this Privacy Policy.  You may choose not to provide us with your personal information.  However, if you make this choice we may not be able to provide you with the product, service, or information that you requested.

1.            Definitions. 

For the purposes of this Privacy Policy, the following words have the following meanings:

collection” means the act of gathering, acquiring, recording, or obtaining personal information from any source, including third parties, by any means.

consent” means voluntary agreement with the collection, use and disclosure of personal information for defined purposes.  Consent can be either express or implied and can be provided directly by the user or by an authorized representative.  Express consent can be given orally, electronically or in writing.  Implied consent is consent that can reasonably be inferred from an user’s action or inaction.

user” means an individual who uses the Service provided by WinEx, including, but not limited to, a Shipper, a Receiver and anyone who accesses or visits the Sites.

disclosure” means making personal information available to a third party.

employee” means an employee of Winex, and for the purpose of this Privacy Policy only, includes independent and other contractors performing services for WinEx.

personal information” means information about an identifiable individual but not aggregated information that cannot be associated with a specific individual.  For a registered user, such information may include (but is not limited to) billing information, account information, billing records, and any recorded complaints.

Piece” means a single envelope, parcel, container, or other article accepted by WinEx for delivery.

“registered user” means an individual who has created and registered an account with WinEx.

Shipment” means one or more Pieces sent on the same date and at the same time, with the same WinEx service and other identical shipment characteristics, from one Shipper to one Receiver at one address under a Shipping Document.

Shipper” means the party tendering a Shipment to WinEx for carriage.

Shipping Document” means any shipping document, label, waybill, manifest or similar instrument used by WinEx to accept Shipments for carriage.

third party” means an individual other than the user, or the user’s agent, or an organization outside WinEx.

use” means the treatment, handling, and management of personal information by and within WinEx.

WinEx” means 6857559 Manitoba Ltd. o/a WinEx Services, including all of its affiliates, subsidiaries, shareholders, officers, directors, agents, representatives, contractors, suppliers, and employees.  From time to time, WinEx is referred to in this Privacy Policy as “we”.

2.            Purpose of Collection

WinEx collects your personal information for the following purposes:

  1. if you are a registered user, to establish and maintain your Sites account;
  2. to provide the ongoing products, services or information that you request;
  3. to verify your identity if you submit a Shipping Document or other content to the Sites;
  4. to process purchases, provide invoices and to carry out Shipments;
  5. to assist you in tracking your Shipment;
  6. to provide customer support to assist you with your questions or complaints;
  7. to collect amounts owing to WinEx;
  8. to manage and develop the business and operations of WinEx, including to analyze where our users are located, to determine the systems or devices for which we should optimize our system, and to troubleshoot network and system problems;
  9. to improve users’ experience of the Sites, including to customize website settings;
  10. to detect and protect against fraud and error;
  11. to track and analyze your purchases and preferences to better understand your product and service needs and eligibility for discounts;
  12. to develop, promote and manage our products and services, including the completion of market studies and the communication of new products and services, special offers, promotions, and service tips;
  13. to meet legal and regulatory requirements.

3.            Collection

WinEx may collect any or all of the following personal information if the information is reasonably required to provide the services accessed or requested by you:

  1. information that you provide when you become a registered user or otherwise complete forms, including but not limited to, Shipping Documents, such as your name, email and postal address, and telephone number;
  2. your log-in and password details in connection with your Sites account, including your username;
  3. information that you provide when you make a transaction, including products and services purchased, method of payment, amount paid, and credit card or payment account information;
  4. proof of identity (such as signature);
  5. information about your personal preferences, including marketing consents;
  6. your correspondence with WinEx employees, including any questions, concerns or comments you may have about the Service or problems that you report;
  7. any content that you may post to the Sites;
  8. details of your requests made through the Service.

4.            Use

WinEx may use your personal information as is reasonably required to:

  1. verify your identity when you sign into your account or contact our customer service department;
  2. verify your credit card/debit card/payment account or other financial information;
  3. provide you with the services that you have requested, including to process and carry out your Shipments;
  4. to collect amounts owing to WinEx;
  5. administer your Sites account;
  6. provide tracking updates with regard to your Shipment;
  7. respond to questions, comments, requests or complaints that you submit to WinEx;
  8. analyze use of the Sites and to improve the Service;
  9. send sales emails, news emails, or regular mail that you have consented to receive from WinEx;
  10. provide Service-related announcements or notifications to you; and
  11. fulfill a purpose that we disclose to you when we request your personal information.

5.            Disclosure

WinEx may disclose your personal information to:

  1. a third-party payment processing company;
  2. third-party companies that provide WinEx with database services and information validation services;
  3. an agent used by WinEx to collect an outstanding account;
  4. a person who, in the reasonable judgment of WinEx, is seeking the information as your agent; and
  5. a third party or parties, where you consent to such disclosure or the disclosure is required by law.

When transferring personal information to third parties, WinEx uses contractual or other means to provide a level of protection comparable to WinEx’s own level of protection while the personal information is in the third party’s custody. Due to the location of some of these third parties or the location of their computer servers, personal information is sometimes transferred, processed and held outside of Canada or on virtual servers.

WinEx does not have control over, and is not responsible for, personal information that a user may disclose about another user via the Service.  When a user provides us with personal information relating to an individual other than themselves (such as the intended recipient of the Shipment), we rely on the user who is providing us with the personal information to obtain that individual’s consent to our collection, use and disclosure of their personal information in the circumstances described above.

Except as stated above, WinEx will not, without our users’ consent, sell, share, transfer, license, trade or rent personal information received from them to others.

6.            Safeguarding Your Personal Information

WinEx is committed to safeguarding your personal information.  WinEx uses appropriate security measures to protect personal information against risks such as loss or theft, unauthorized access, disclosure, copying, use, modification or destruction regardless of the format in which it is held.  The methods of protection and safeguards used by WinEx include, but are not limited to, locked filing cabinets, need-to-know access and technological measures including the use of passwords, encryption and firewalls.  While WinEx cannot guarantee that risks such as loss, theft, unauthorized access or disclosure of personal information will not occur, WinEx will make every effort to prevent such unfortunate occurrences.

WinEx takes care in disposing of or destroying personal information to prevent unauthorized parties from gaining access to the information.  WinEx also ensures that its employees with access to personal information are made aware of the importance of maintaining the confidentiality of personal information.  Finally, WinEx protects personal information disclosed to third parties by contractual agreements stipulating the confidentiality of the information and the purposes for which it is to be used.

7.            Accuracy

WinEx is committed to keeping your personal information as complete, up-to-date, and accurate as is necessary for the purposes for which it is to be used.  WinEx will promptly correct or complete any personal information found to be inaccurate or incomplete.  Where appropriate, WinEx will transmit amended information to third parties having access to the personal information in question.  Upon request, WinEx will provide you with a reasonable opportunity to review the personal information in your file to review its accuracy.  Such personal information will be provided within a reasonable time of the request and at a minimal or no cost to you.

Also upon request, WinEx will provide an account of the use and disclosure of your personal information and, where reasonably possible, will state the source of the information.  In providing an account of disclosure, WinEx will provide a list of organizations to which it may have disclosed personal information about you when it is not possible to provide an actual list.

8.            Complaints

WinEx will promptly investigate all complaints concerning our compliance with the Privacy Policy and our dealings with your personal information.  If a complaint is found to be justified, WinEx will take appropriate measures to resolve the complaint including, if necessary, amending WinEx’s policies and procedures.  You will be informed of the outcome of the investigation regarding your complaint.

9.            Withdrawing Consent

You may withdraw your consent to the collection, use or disclosure of your personal information by WinEx at any time, subject to legal or contractual restrictions and reasonable notice.  In certain circumstances, your withdrawal of consent will result in the inability of WinEx to continue providing aspects of the Service to you.  Please contact WinEx for more information regarding the implications of withdrawing consent.

10.          Non-Personal Information

Non-personal information is information that does not identify you and which we are unable to connect to other information in order to identify you.  WinEx may collect any or all of the following non-personal information:

    1. The Sites use Google Analytics, a web analytics service provided by Google, Inc. (“Google”).  Google Analytics uses “cookies,” which are text files placed on your computer, to help the website analyze how users use the Sites.  The information generated by the cookie about your use of the Sites (including your IP address) will be transmitted to and stored by Google on servers in the United States.  Google will use this information for the purpose of evaluating your use of the Sites, compiling reports on Sites activity for the Sites’ operators and providing other services relating to website activity and Internet usage.  Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf.  Google will not associate your IP address with any other data held by Google.  You may refuse the use of cookies by selecting the appropriate settings on your browser: however, please note that if you do this, you may not be able to use the full functionality of the Sites.  By using the Sites, you consent to the processing of data about you by Google in the manner and for the purposes set out above. Google currently offers a free Google Analytics opt-out tool for Internet Explorer (versions 7 and 8), Google Chrome (4.x and higher) and Mozilla Firefox (3.5 and higher) which is available at http://tools.google.com/dlpage/gaoptout.
    2. We may also use additional analytics programs from time to time to process non-personal information about you.

11.          Email Management – Canada’s Anti-Spam Legislation (“CASL”)  

From time to time, WinEx sends to its customers or other persons commercial electronic messages including surveys, invitations, and messages relating to its new products, services, special offers, promotions, contests, and service tips. WinEx endeavours to obtain express consent before sending these messages and, where required by law, includes an option to unsubscribe in the message. Recipients who no longer wish to receive these types of messages from us may unsubscribe from our mailing list. Once a recipient has unsubscribed from our list (a request with which WinEx will comply with 10 business days), WinEx will no longer send commercial electronic messages to the email address that was used by the recipient to unsubscribe. If a recipient has more than one email address, each email address must be unsubscribed from our list. After an unsubscribe request is performed, a recipient may continue to receive other types of email messages from WinEx that do not fall within the definition of “commercial electronic messages”, such as emails that are generated by our Sites in connection with the creation of a Shipment or those that relate to the management of a user’s account.

WinEx encourages customers or other affected persons to bring forward any complaints about WinEx’s email practices to the attention of WinEx’s Privacy and CASL Compliance Officer using the contact information provided below.

13.          Privacy Policy Changes

To accommodate changes in our services, changes in technology, and legal developments, this Privacy Policy may change over time without notice to you. We may add, change, or remove portions of the Privacy Policy when we feel it is appropriate to do so. We encourage you to review our Privacy Policy periodically.  Each time you submit personal information or use the Service you agree to be bound by terms of the Privacy Policy which is then current. Whenever we update the Privacy Policy, we will change the date below to indicate when the changes were made.
